Congratulations on your decision to join our Kwanda Kids Program!  We trust that your child/ren will flourish and enjoy our program tremendously while developing all the neuro-motor skills necessary for future scholastic success.

Kwanda Kinetics Child Development And Therapy Centre is a private Kinderkinetics practice in South Africa.  In terms of Section 11 of the Electronic Communications and Transactions Act 25 of 2002, as amended (“ECTA”), the following Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity, as well as Kwanda Kinetics, concerning your child participating in Kwanda Kids and your access to the Kwanda Kinetics website.

 

If you do not agree with the following Terms and Conditions, do not accept and do not sign your Kwanda Kids contract.

TERMS AND CONDITIONS

1. I hereby state that my child is healthy and give permission that he/she may participate at his/her own risk in the evaluations and Kinderkinetic sessions presented by Kwanda Kinetics. 

2. I understand that all the necessary precautions will be taken by Kwanda Kinetics to ensure the safety of my child.  However, I acknowledge that little children are more prone to accidents than adults as they still learn where they are in space and how to use their muscles correctly, regardless of the place or situation. Therefore, I am aware that neither Kwanda Kinetics nor its owner, agents, employees, volunteers or any person associated with Kwanda Kinetics accepts responsibility for any loss, injury or damage that my child/children or property of my child/children may sustain as a result of either directly or indirectly participating in any or all of the programs presented by Kwanda Kinetics and understand that Kwanda Kinetics and/or its owner, agents, employees, volunteers or any person associated with Kwanda Kinetics cannot be held liable for the above-stipulated, except in the case of gross negligence.

3. I hereby waive any right that I or my child may have to claim compensation against Kwanda Kinetics and/or its owner, agents, employees, volunteers or other members associated with Kwanda Kinetics, in respect of any loss, injury or damage incurred whilst engaged in any activity howsoever arising, whether directly or indirectly and I indemnify Kwanda Kinetics against all such claims, except in the case of gross negligence.

4. I give permission that Kwanda Kinetics may contact me to communicate any information relevant to my child’s development. For this reason, I will inform Kwanda Kinetics in writing should any of my personal details change.  I also understand that I can willingly join any other social media or communication platform to receive prompt and up-to-date information regarding the Kwanda Kids classes.  These additional platforms will be communicated to me by my child’s Kinderkineticist. 

5. I understand that Kwanda Kinetics will not disclose my information to a third party for marketing purposes. As it is in the best interest of my child, I further give permission that any appropriate information pertaining to my child's development may be disclosed and shared between the Kinderkinetici of Kwanda Kinetics, the teacher and/or principal of our school and/or any other medical related profession, should it be necessary.

6. I also give permission that Kwanda Kinetics may use photos of my child/children for marketing purposes, unless indicated otherwise by me in writing.  In such a case, I take note that I will need to send a notification email to Kwanda Kinetics to inform them NOT to use any photos of my child.  I also take note that I need to receive a confirmation email from Kwanda Kinetics as proof that they have received my notification email.

7. A registration fee of R175 is to be paid when enrolling my child.  This fee covers the administration fee, a gift bag, a medal as well as a certificate at the end of the year.  The registration fee is non-refundable.  

8. The program fee is R675 per term OR R270 per month (10 installments from February to November).  For administration as well as security reasons, no cash payments are allowed.  An internet transfer (EFT) can be made using my child’s name AND surname as reference.  A 10 % discount will apply if I have more than 1 child participating in the Kwanda Kids program.

9. I take note that my child will receive individual assessments twice a year - one assessment towards the end of the first term and one assessment towards the end of the fourth term.  I also take note that my child will not receive any Kwanda classes during the individual assessment period and that my child can only be assessed if he/she is attending school during the assessment period.  Each assessment period will be communicated in a newsletter that will be sent to me via email and/or Whatsapp, should I choose to join the Kwanda Kids Safariland Whatsapp group as per invitation.

10. I hereby renounce the benefits of legal exception ‘no cause of debt’, ‘misunderstanding’, ‘no value received’ and ‘error of calculation’.

11. I will be given no deduction, discount or refund by reason of my child’s absence from any or all the lessons to relieve me of my obligations in terms of this agreement and understand that full term fees are still due.

12. I take note that there is no reduction in fees in the event of cancellation due to rain and understand that Kwanda Kinetics will do its best to make up the affected lessons whenever and if it is possible.

13. Kwanda Kinetics reserves the right to terminate my child’s lessons if fees are in arrears.

14. I undertake and accept liability for one term's written notice should I decide to stop with the Kwanda Kids program.  I take note that all fees are payable during the notice period.

15. I take note that the program fees will increase at the beginning of each new school year.

16. In the event of legal proceedings being instituted against me in respect of this indebtedness, I undertake to pay all legal costs incurred, including attorney and client costs, collection commission and any other legal charges that may be levied against me. 

17. I take note that interest at the highest rate allowed by the Credit Agreement Act 2007 will be charged by Kwanda Kinetics for any outstanding amount over 45 days.

18. This contract and consent form will be valid from the date of signature and will remain of force even though significant time has elapsed between when the consent was obtained by Kwanda Kinetics and the information of my child’s development was shared. 

19. I confirm that this contract and consent form will not be without legal force and effect if it was concluded partly or in whole by means of data messages.  By undersigning this contract and consent form, I hereby confirm that I have read and understood the contents hereof.
